Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and PizzaParties LLC, a limited liability company organized under the laws of South Carolina, the owner and operator of the ClassWizards platform ("ClassWizards", "Platform", "Service", "we", "our", or "us"). By accessing or using ClassWizards in any manner, including creating an account or inputting any data, you ("you," "User," "Teacher," "Administrator," or "School Personnel") agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1. Platform Overview and Eligibility

ClassWizards is a teacher-managed classroom gamification system that transforms positive behavior into epic quests. The platform is designed exclusively for educators to engage students through game-based learning experiences. Students participate through teacher-supervised classroom displays without creating personal accounts.

By creating an account or using the Platform, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into this agreement
• You are an authorized educator or school personnel with proper credentials
• You have authority to implement classroom management tools within your educational role
• All information provided during account creation and use is accurate, current, and complete
• You will promptly update any information to maintain its accuracy

You are solely responsible for maintaining the confidentiality and security of your account credentials. You must immediately notify us at hello@classwizards.com of any unauthorized access or security breach.

2. How ClassWizards Works

ClassWizards operates through the following process:

• Teachers create accounts and set up their classroom environments
• Students are organized into teams that compete together
• Teachers launch quests where positive behavior earns experience points
• Teachers award EXP to students for good behavior, completing work, etc.
• Student characters level up and earn equipment as they progress
• Teams compete to complete quests and earn real-world rewards
• Students do not create accounts or provide personal information

3. Subscription Plans and Payment

3.1 Free and Pro Plans

ClassWizards offers both free and paid subscription options:

• Free Plan: Access to the first 2 quests for all classrooms
• Pro Plan: Access to all quests for all classrooms

3.2 Payment Terms

For Pro subscriptions:

• Subscriptions are billed monthly or annually, depending on your selection
• Payment is processed securely through Stripe
• You authorize us to charge your payment method on a recurring basis
• Prices may change with 30 days notice before your next billing cycle

3.3 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Upon cancellation, you retain access until the end of your current billing period
• Your classroom progress is preserved if you re-subscribe later

4. Permitted Use and Restrictions

You may use ClassWizards solely for lawful, educational purposes related to classroom engagement within your authorized educational role. You expressly agree not to:

• Use ClassWizards in any manner that violates federal, state, or local laws
• Misrepresent your identity, school affiliation, credentials, or authorization to use the platform
• Input information about students without proper educational authority
• Use the platform to harass, discriminate against, harm, or exploit any individual
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Upload, transmit, or distribute any malicious code, viruses, or harmful content
• Use the platform for any commercial purposes outside your educational role
• Reverse engineer, decompile, or attempt to extract source code from the platform
• Share account credentials or allow unauthorized individuals to access your account

5. Data and Privacy Framework

ClassWizards is designed with privacy-first principles. The platform collects minimal information necessary for classroom gamification:

• Teacher account information (email address)
• Student first names only (entered by teachers)
• Classroom progress data (experience points, levels, quest completion)
• Technical data necessary for platform operation

You represent and warrant that:

• You have proper educational authority to track student engagement and progress
• You comply with your institution's policies regarding classroom management tools
• You will use appropriate discretion when entering any student information
• You understand that all classroom data remains under your control and ownership

6. Data Ownership and Control

All data input into ClassWizards by you remains your exclusive property. PizzaParties LLC acts solely as a service provider and does not claim any ownership rights to your classroom data. Your rights include:

• Full ownership and control of all classroom data
• Right to access, modify, or delete any data at any time
• Right to delete classrooms and student records
• Right to direct how data is processed and used within the platform

7. Account Termination

Our Right to Terminate: We reserve the right to suspend or terminate your access to ClassWizards immediately, with or without prior notice, for conduct that we reasonably believe violates these Terms, applicable laws, or poses harm to the platform or its users.

Your Right to Terminate: You may terminate your account at any time by contacting hello@classwizards.com or through your account settings.

Effect of Termination: Upon termination, your access will cease immediately, but your data will be preserved for 90 days to allow for recovery. After this period, all data will be permanently deleted unless legally required to be retained.

8. Warranties and Liability

8.1 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, CLASS WIZARDS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIZZAPARTIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF CLASS WIZARDS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8.3 Indemnification

You agree to indemnify, defend, and hold harmless PizzaParties LLC from any claims, damages, or expenses arising from your use of ClassWizards in violation of these Terms or applicable laws.

9. Security and Data Protection

We implement appropriate technical and organizational measures to protect your data, including:

• Encryption of data in transit and at rest
• Passwordless authentication (magic links) for enhanced security
• Access controls and authentication measures
• Incident response and breach notification procedures

In the event of any security incident that may compromise your data, we will notify you within 72 hours of discovery and provide detailed information about the incident and remedial actions taken.

10. Intellectual Property

The Service and its original content, features, functionality, artwork, and game mechanics are owned by PizzaParties LLC and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our platform

11. Modifications to These Terms

We may update these Terms periodically to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via email to your registered address and through prominent notice on the platform at least 30 days prior to implementation. Continued use of ClassWizards after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in South Carolina.

Prior to initiating any legal proceedings, the parties agree to attempt resolution through good faith negotiation for a period of 60 days after written notice of the dispute.

13. Additional Legal Provisions

13.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PizzaParties LLC regarding ClassWizards and supersede all prior agreements and understandings.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
